Arno Carstens in court for drunk driving

Cape Town - The Cape Town Magistrate's Court heard that local musician Arno Carstens smelled of alcohol and staggered on his feet when he was arrested for drunk driving a few years ago, it was reported on Wednesday.

According to the Cape Argus, Constable Lionel Galant told the court on Tuesday that he pursued a black Mercedes-Benz with tinted windows around 23:00 on 19 December 2010, but that the car kept turning into side roads.

The car, which the former Springbok Nude Girls frontman was driving, eventually stopped when Galant sounded his siren.

"I... asked him to get out. I noticed he was unsteady on his feet and... he smelled of alcohol," the policeman reportedly said.

"I asked the accused if he had had anything to drink. He said yes and that he just came from a party where he had a few beers."

Carstens has denied the allegations.

His attorney Milton de la Harpe reportedly said he would lead expert evidence that alcohol did not smell and that one could stagger for many reasons.

He also accused Galant of fabricating his evidence after going through transcripts of the case.

The trial continues later on Wednesday.

 

Zenani Mandela crash: Driver acquitted

Johannesburg - The driver in the fatal crash that killed Nelson Mandela's great-grandchild in 2010 was acquitted on Tuesday of all charges related to her death, due to lack of evidence, his lawyer said.

Sizwe Mankazana was charged with culpable homicide, reckless and negligent driving and driving under the influence of alcohol after he lost control of his vehicle, killing 13-year-old Zenani Mandela.

The accident happened on the eve of the 2010 FIFA Soccer World Cup, when the pair were returning from a concert in Soweto.

Mandela missed the opening of the event because of the tragedy.

According to Mankazana's lawyer, Hulme Scholes, the magistrate said there was no evidence "which could reasonably lead to a conviction on any charge".

Mankazana is the son of Zwelakhe Mankazana, the partner of Mandela's daughter Zenani Mandela-Dlamini, who is the country's ambassador to Argentina.

"The tragedy is that we will all live the rest of our lives without her. 

"I am thankful that the trial has come to an end," Mankazana said in a statement.

“Dronkbestuur is ’n keuse”, “Teregstelling deur voertuig” en “Killer drivers: it’s about time – Jail time”.

Dit was van die plakkate wat ’n groep mense gister buite die Hatfield-gemeenskapshof in Pretoria in stille protes teen dronk en roekelose bestuurders vasgehou het.

André Nel het met ’n plakkaat met ’n foto van sy broer op in die hofsaal gestaan waar Gunter Geyer op aanklagte van strafbare manslag en dronkbestuur verskyn het.

Geyer (21), die seun van adv. Karen van Rensburg van die nasionale vervolgingsgesag, het vroeër skuld beken.

Hy het Louis Willem Andries Nel (64), besturende direkteur van die farmaseutiese maatskappy Brunel, en sy drafvriend, in die oggendure van 20 April 2011 van agter af met sy motor getref terwyl hulle in Lynnwoodweg, Pretoria, gedraf het.

Nel is op die toneel dood en sy vriend beseer. Geyer is op die toneel gearresteer en later op waarskuwing vrygelaat.

Die saak is gister vir voorvonnisverslae en vonnisverrigtinge uitgestel omdat die landdros siek was.

Daarby het Wessie Wessels, Geyer se prokureur, aangedui hy wil graag voor die vonnisverrigtinge ’n deskundige raadpleeg.

Buite die hof het Emsie Frank, ’n vriendin van Nel se dogter, Paulet, gesê hulle het die vreedsame betoging gereël om bewustheid te wek oor al die drawwers en fietsryers wat oor die jare op die paaie “afgemaai is”. “Ons hoop om deur groter bewustheid nog sulke tragedies te verhoed. Ons wil die regering se aandag op die probleem vestig, want iets drasties sal aan dronkbestuurders gedoen moet word.” 

Karen Meyer, DA-woordvoerder oor gemeenskapsveiligheid in die Tshwane-metro, het gesê: “Tussen 60% en 70% van motorongelukke word deur dronkbestuurders veroorsaak.”

Traffic cop 'dragged like an animal'

Potchefstroom - A motorist hit a traffic official and “dragged him like an animal from his bakkie” into bushes before speeding away and later killing a man on a motorbike. 

This was the evidence heard on Wednesday in the Potchefstroom Magistrate’s Court during the bail application of Moeketsi Molefe, 31, an entrepreneur from Klerksdorp. A verdict is expected on September 6.

Molefe is accused of murder, attempted murder, failing to provide medical help, reckless or negligent drivingand drunken driving.
